Permitted Tenant Fees
The following sets out the payments that may be payable by a tenant in connection with a tenancy, in accordance with the Tenant Fees Act 2019 and applicable legislation.
Holding Deposit – one week's rent
A refundable holding deposit of up to one week's rent may be requested to reserve a property while pre-tenancy checks are carried out.
The holding deposit will normally be returned or applied towards the first month's rent or tenancy deposit, with the tenant's agreement, once the tenancy is entered into.
The holding deposit may be retained in certain circumstances permitted by law, including where a relevant person withdraws from the application, fails a Right to Rent check, provides false or misleading information which affects their suitability, or fails to take reasonable steps to enter into the tenancy agreement within the agreed deadline.
Tenancy Deposit – up to five weeks' rent
Where the annual rent is less than £50,000, the maximum tenancy deposit is five weeks' rent.
The deposit is held as security against any loss or damage arising from a tenant's breach of the tenancy agreement and will be protected in a Government-approved tenancy deposit scheme where required.
Late Payment of Rent
Where rent remains unpaid for 14 days or more, interest may be charged at a rate of up to 3% above the Bank of England Base Rate, in accordance with the terms of the tenancy agreement.
Lost Keys or Security Devices
Where a tenant loses a key or other security device giving access to the property, the tenant may be charged the reasonable costs actually incurred in replacing it.
Where the loss requires a lock to be changed, the reasonable costs of the locksmith, replacement lock and replacement keys may be charged. Any costs must be supported by appropriate evidence.
Variation of Tenancy – Tenant's Request
Up to £50 including VAT per agreed variation, where the tenant requests a change to the tenancy agreement.
Where the reasonable costs of the variation exceed £50, a higher charge may be made provided the costs are reasonable and evidence can be provided.
Change of Sharer – Tenant's Request
Where a tenant requests a change of sharer, this is treated as a variation of the tenancy.
Up to £50 including VAT, or the reasonable costs actually incurred where these exceed £50.
This may include the costs associated with obtaining the landlord's instructions, referencing the proposed tenant, carrying out Right to Rent checks and preparing the necessary tenancy documentation.
Early Termination – Tenant's Request
If a tenant asks to leave the tenancy before the required notice period has expired, the landlord may require payment in accordance with the Tenant Fees Act 2019.
Any payment will be limited to the landlord's actual loss or the rent due until the required notice period expires, whichever is applicable, and must not exceed the maximum amount permitted by law.
